Acceptance of Terms and Conditions

When we confirm your booking with us, we are entitled to assume that you have had the opportunity to read and have read these terms and conditions and agree to them.

When you make a booking with us and we have received the required deposit or taken a debit or credit card number to secure the booking we will provide written confirmation of the booking to you. A legally binding Contract of Hire then exists between us that is non-cancellable and non-refundable, except in exceptional circumstances.

The Contract of Hire is governed by Scottish law and jurisdiction and is not effective until written confirmation of the booking has been provided to the Hirer. The contract is for the hire of the property for holiday purposes only. We do not accept bookings from Hirers under 21 years of age.

In the event of any dispute between parties it shall be referred to the jurisdiction of the Scottish courts and shall be governed by Scottish law and jurisdiction.

Prices

Prices shown are per Cottage for a 7-day booking. Other periods are sometimes available, and prices are agreed prior to booking.

Number of Guests

Red Squirrel Cottage is situated on the first floor and can accommodate a maximum of 3 guests in two bedrooms. Garden Cottage is located on the ground floor and can accommodate a maximum of 2 guests in one bedroom. The cottages are joined by a staircase and can be let together as a three-bedroom property, accommodating a maximum of 5 guests. Children of 12 years and over are welcome provided that the total number of guests does not exceed the maximum permitted.

Under no circumstances may more than the maximum number of persons as stated above occupy each cottage. Additional guests cannot be added to a booking once that booking has been confirmed without prior approval from Cuil-an-Duin Country House. Visits by non-resident family and friends are strictly by prior arrangement with Cuil-an-Duin Country House who reserve the right to ask any unauthorised visitors to leave.

Reservations and Deposit

Bookings at Cuil-an-Duin Country House cottages will be confirmed on receipt of a deposit equivalent to 30% of the total holiday cost. We accept payment by cash, bank transfer, cheque (payable to ‘Cuil-an-Duin Country House’) or debit / credit card. Payment can be made through our booking system or directly with us.

The full balance is payable 8 weeks prior to the holiday start date. Cuil-an-Duin Country House reserves the right to cancel a holiday where full payment has not been received 8 weeks before the start date. Bookings made within 8 weeks of the holiday start date are payable in full on booking.

Cuil-an-Duin Country House reserve the right to refuse to accept bookings from parties consisting solely of young adults. The Hirer should make the nature of the group known when booking.

Cancellation

For cancellation within 8 weeks of the planned start date, the Hirer shall be held responsible for the full rental fee unless Cuil-an-Duin Country House re-let the cottage, in which case a refund will be made less a deduction for costs incurred. Cancellation greater than 8 weeks from the planned start date will result in a loss of deposit, unless Cuil-an-Duin Country House re-let the cottage. Cancellations must be notified immediately and confirmed in writing/by email.
We suggest that guests take out adequate travel insurance to cover unforeseen cancellations.

Where deposits are paid by debit/credit card, it is agreed between the parties that in the event of cancellation we may debit the guest’s debit/credit card with the full amount of the cancellation.

Arrival and Departure Time

Bookings begin at 4.00pm on arrival day and end at 10.00am on departure day.

Damages and Breakages

The Hirer is responsible for the property and is expected to take all reasonable care. All accommodation and utensils must be left clean and tidy at the end of the hire period. An additional charge may be made for cleaning if the cottage is not left in a clean and tidy condition. All breakages or damage to the property, fixtures, fittings or equipment caused by the Hirer or any member of their party must be reported promptly. Please report these as soon as they occur. We do not normally charge for minor damage or breakages, but we reserve the right to make a charge to the Hirer’s credit/ debit card, or we may send you an invoice, for repair or making good if the damage or breakage is significant. We may make an additional charge if you did not report this. The person making the booking certifies that they agree the terms and conditions on behalf of all members of their party.

The holidaymaker shall ensure that the holiday accommodation is securely locked when not occupied during the period of the holiday let and shall ensure that all keys are left at the property on departure. Failure to comply with this term may result in an additional charge being made.

The holidaymaker shall undertake to prevent any member of his party from causing a nuisance or disturbance to other residents. In the event of a problem arising, the Owner has the right to ask the holidaymaker to leave.

The holidaymaker agrees to allow the property Owner and its agents reasonable access to the property.

Our Liability

Limited liability. Save in respect of any death or personal injury claim caused by the negligence of the Property Owner, the Property Owner cannot accept liability for any damage, expense or loss of any nature whatsoever suffered by any person(s) from any cause whatsoever.

Save in respect of any death or personal injury claim caused by the negligence of the Property Owner, any other liability of the Property Owner under this Agreement shall be limited to the rental value of the relevant booking at the Property.

The Property Owner shall not be liable to you for any loss of profit, consequential loss or other indirect losses under the terms of this Agreement.

The use of the accommodation and amenities at Cuil-an-Duin Country House is entirely at the users’ risk. No responsibility can be accepted for loss, damage or injury to users or their belongings. We do not accept liability for damage, loss or injury to any member of your party or any vehicles or possessions, unless proven to be caused by a negligent act by ourselves or our employees or contractors whilst acting in the course of employment.

Cuil-an-Duin Country House is situated within approximately 20 acres of woodland and adjacent to farmland. The paths around the woodland areas are informal and can be hazardous. Whilst guests are welcome to use the amenities and grounds, they are reminded that they do so entirely at their own risk and are asked to respect the local environment.

We may terminate our contract with you and ask you to leave your accommodation immediately (without any compensation being payable) if we consider that you or your party have committed a serious breach of these terms and conditions; we consider that you or your party’s behaviour endangers the safety of our visitors or staff; any complaints are made of anti-social or unacceptable behaviour against you or your party; you or your party cause an unreasonable amount of damage to the property or its contents; or you exceed the maximum occupancy limit for your accommodation.

Non-availability

We would only cancel your booking if your accommodation was unavailable for reasons beyond our control. We would attempt to offer you alternative accommodation, however if this was not possible, or unacceptable to you, then we would refund all monies paid by you. Our liability would not extend beyond this refund.

If the Hirer is not entirely satisfied with the accommodation the owners must be informed immediately to help remedy the situation as no discussion can be entered into after the end of the holiday.

Other Terms and Conditions

Smoking is not permitted anywhere within the cottages or grounds at Cuil-an-Duin Country House.

There are no additional charges for linen, electricity, heating, and water services. A basket of logs will be provided as part of the welcome pack in Garden Cottage. Further logs are available, on request.

Animals

We have a number of pets and wildlife at Cuil-an-Duin Country House including dogs, cats, hens, deer and red squirrels and we ask that guests drive very slowly when entering and exiting the property.

Guests are not permitted to bring any pets or leave pets in cars. Registered assistance dogs are of course welcome.

Data

Any data gathered during the course of your booking may be held on our computer. Unless you otherwise request we will store your name and email address in order that we can give you occasional updates on Cuil-an-Duin Country House news and offers.
